(a) Although the intent of any safe work behavior compliance policy is not to remove the employee from partial or full employment, the interest in creating a safe work environment and eliciting safe work behavior from employees is paramount.
(b) The following procedure represents the final attempt of the City to notify an employee that an unsafe work behavior must be changed:
(1) Any employee observed committing an unsafe work behavior and who has previously received verbal and written warnings for other unsafe work behavior shall be recommended for suspension without pay for a minimum of one work day.
(2) The supervisor who witnessed or was informed of the unsafe work behavior shall document the behavior after notifying the employee of the unsafe behavior, its consequences and the intent to notify a superior of the infraction.
(3) Once notified, the department head shall notify the Director of Safety of
the infraction in writing.
(4) The Director of Safety shall document the dates of and reasons for prior warnings and the preconditional reprimand. The Director of Personnel shall determine if the complaint merits suspension of the employee without pay.
(5) If the investigation shows that the employee knowingly committed unsafe work behaviors, the Director of Safety shall notify the Mayor and request that the employee be suspended in accordance with Civil Service Rules and Regulations.
(6) Record of such a suspension is detailed in the employee's work record and represents the final stage in the City's safety compliance process.
