121.04 PRESIDING OFFICER; DUTIES AND AUTHORITY; VACANCY.
   (a)    Duties and Authority. The Presiding Officer of Council shall be the President of Council, who shall have the following duties and authority:
      (1)   The President of Council shall preserve strict order and decorum at all regular and special meetings of Council and in relation thereto shall prevent personal reflection and confine Council members in debate to the question, and the President may, in common with any other member, call any member to order who violates any of the rules herein.
      (2)   The President of Council shall state every question coming before Council, announce the decision of Council on all subjects and decide all questions of order.
      (3)   Notwithstanding serving as the Presiding Officer, the President of Council shall not lose the ability to vote nor cease to have all rights of a Council member.
      (4)   The President of Council may make motions and second the motions of others.
      (5)   Unless provided otherwise in the Charter or the Codified Ordinances, the President of Council shall approve all expenditures from the funds appropriated by Council in the annual budget of the Council.
      (6)   The President of Council shall have the authority to interview candidates to fill the position of Clerk of Council and to provide to Council members the candidates chosen and not chosen by the President of Council to stand for election by the Council as a whole as required by the Charter.
      (7)   The President of Council shall supervise the Clerk of Council and the Clerk shall serve the Council as a whole.
   (b)   Vacancy. When a vacancy occurs in the office of the President of Council, the Council shall, no later than the Council meeting following the vacancy, elect one of its own members to be the President of Council. The Clerk shall call Council to order whereupon Council shall elect by majority vote one of their members as President of Council.
