1103.09 UNDERGROUND FACILITIES IN NEW SUBDIVISIONS; BOND.
   (a)    In new subdivisions, all gas distribution mains, telephone cables, electric power and street lighting wires, conduits or cables to serve lots in such subdivision shall be constructed underground and upon easements provided for utilities, ten feet in width adjacent to and parallel with the road right of way of such subdivision, except gas pipe lines may be installed within the road right of way and gas mains, wires, conduits or cables owned by or on the customer's property, need not be located upon easements.
   (b)    All gas distribution mains, underground telephone cables, electric power and street lighting wires, conduits or cables shall be constructed in accordance with the standards required in Administrative Order No. 72 of The Public Utilities Commission of Ohio or of other regulations of the Public Utilities Commission of Ohio.
   (c)    Bases must be provided for the ultimate installation of street lighting standards on minor streets by the electric utility serving the subdivision at a minimum mounting height for luminaires of fifteen feet and spaced no farther apart then every fourth lot.
   Bases must be provided for the ultimate installation of street lighting standards on major or collector streets by the electric utility serving the subdivision to provide lighting intensity meeting the minimum recommendations of American Standard Practice for Roadway Lighting.
   Until used, the wiring in such bases shall be safely insulated and/or de-energized.
   (d)    The preliminary plat with respect to any new subdivision shall be submitted to all utility companies serving the subdivision, as well as the Building Inspector, for their recommendation.
   (e)    Utility easements at least ten feet in width for gas distribution mains, telephone, electric power and street lighting distribution lines and facilities shall be provided on all front lot lines adjacent to and parallel with the road right of way.
   (f)    Prior to granting final approval, the subdivider shall have installed or shall have furnished adequate bond for the ultimate installation in accordance with the requirements of this chapter as follows:
      (1)    Underground telephone cables.
      (2)    Underground distribution cables for power and street lighting from a common distribution system, and the equipment and housing necessary in the operation of the distribution system.
      (3)    Adequate provision for street light lamps and standards in accordance with a design approved by Council.
   (g)    Council may authorize a variance from these regulations when undue hardship may result from strict compliance. In granting any variance, Council shall prescribe only conditions that are deemed necessary or desirable for the public interest and finds that there are special circumstances or conditions affecting the property such that the strict application of the provisions of this chapter would deprive the applicant of the reasonable use of his land.
