There is hereby created a non-exclusive franchise granting to the grantee thereof whose bid may be accepted the right to construct, erect, operate, and maintain upon, through, along, under, and over the rights-of-way of the city, a telecommunications system (or a related system which is not otherwise a cable system) embracing equipment and apparatus necessary, essential, used or useful to and in the operation a of telecommunications system, subject to all of the provisions of this chapter. This franchise does not excuse the grantee thereof from complying with any and all applicable existing and future local laws and ordinances as may be adopted or amended in the future, and their pursuant regulations. It shall be unlawful for any person to erect, construct, maintain, or operate a telecommunications system in, upon, along, across, over, above, and under the rights -of-way of the city without a valid franchise therefore.
