§ 123.06 VIOLATIONS.
   (A)   Any violation of the provisions of § 123.02 shall be a Class A misdemeanor punishable by a fine of not less than $250 nor more than $500, or imprisonment for not less than 30 nor more than 365 days, or both fine and imprisonment, and each day the violation shall exist shall be considered to be a separate offense. Any agent, servant, or employee on the premises at the time of the discovery of a violation of § 123.02, together with the owner(s) of the adult establishment, shall have responsibility for such violation. The term "owner" for purposes of this provision shall be defined to include, in the case of a proprietorship, the proprietor(s), in the case of a partnership, the partners, in the case of a limited liability company, the members, and in the case of a corporation, the officers, directors, and shareholders.
   (B)   Any violation of the provisions of § 123.03 shall be a Class A misdemeanor punishable by a fine of not less than $250 nor more than $500, or imprisonment for not less than 30 nor more than 365 days, or both fine and imprisonment, for each offense. Any agent, servant, or employee on the premises at the time of a violation of § 123.03 shall have responsibility for such violation.
