§ 100.01 DEFINITIONS.
   For the purpose of this subchapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   DECONTAMINATION STANDARD. The standards set forth in the administrative regulations relating to the decontamination of property where the unlawful manufacture of methamphetamine has taken place as promulgated by the Kentucky Energy and Environment Cabinet and codified at 401 KAR 101:040, as same may be amended from time to time.
   INHABITABLE PROPERTY. Any building or structure that is intended to be occupied by people as a residence or place of lodging, whether the residency or lodging be temporary or permanent, including, without limitation, houses, duplexes, multi-plexes, apartments, condominiums, townhouses, mobile homes, bed and breakfast facilities, and hotel and motel rooms.
   PROPERTY OWNER. The person or entity identified as the owner of the property in question and at the address reflected by the records on file in the office of the Madison County Property Valuation Administrator.
   PROPERTY WHERE METHAMPHETAMINE HAS BEEN MANUFACTURED or PROPERTY. Inhabitable property in which the unlawful manufacture of methamphetamine has taken place as confirmed by a state or local law enforcement agency and:
      (1)   In the case of a house, the entire house;
      (2)   In the case of a duplex, multi-plex, apartment building, townhouse building, or condominium building, the entirety of the individual residence wherein methamphetamine was manufactured.
      (3)   In the case of a mobile home, the entire mobile home.
      (4)   In the case of a bed and breakfast facility or of a hotel or motel, the individual room wherein methamphetamine was manufactured.
