§ 96.45 POLICY FOR INSTALLATION OF LIGHTING CREATED; FEES; ASSESSMENT.
   (A)   There is hereby created a policy for the installation of alternative street lighting systems on the streets of the city.
   (B)   The city will continue to provide street lighting as a public service on all streets in the incorporated territory in the city on standard fixtures installed by Kentucky Utilities, Inc. as per the street lighting rate schedule agreement by and between Kentucky Utilities and the city which is subject to adjustments upon approval by the Public Service Commission of Kentucky.
   (C)   Ornamental/decorative lighting is hereby permitted on any street in the city limits as an alternative to the standard fixture installed by the city. All property owners on the street or streets on which ornamental/decorative lighting is installed either by the initial developer or at the request of the residents of a particular neighborhood shall be assessed on an annual basis, the difference in the accumulated monthly rates for that year, for the decorative/ornamental rates charged the city by Kentucky Utilities, Inc. over and above the rate the city pays for standard fixtures.
   (D)   Said fee is to appear on the property tax bills of all benefitted property assessed on an equal basis for the area in which ornamental/decorative lighting exists.
   (E)   All costs associated with the installation of decorative/ornamental lights including any difference in the cost of providing overhead and underground primary and secondary lines will be paid directly by the individuals or developers requesting the installation of the lights.
   (F)   The Director of the Division of Codes and Planning shall annually provide to the Finance Director of the city a list of all streets on which ornamental/decorative lighting exists in the incorporated territory of the city. The assessments for the properties in the area shall be determined by calculating the difference in the rates for standard fixtures installed by the city and the rates for ornamental/decorative lighting for the year for which the tax bills apply and dividing equally the number of properties in the area. The assessment shall be identified as “alternative street lighting” and appear on the property taxes bill.
   (G)   The final plat of all developments shall note the alternate street lighting assessment as part of the recorded plat. The appropriate amendment shall be made to the subdivision regulations to include this regulation.
