§ 96.17 RESURFACING.
   (A)   The grantee of the permit to make a street opening may elect to resurface the filled ditch himself. The grantee of the permit, at the time the permit is granted, shall notify the Director of Streets if he intends to do the resurfacing himself. If he chooses to do the resurfacing himself, he must have the ditch resurfaced within 30 calendar days after the permit is issued. Upon proper completion of the resurfacing, the grantee may notify the Director of Finance and have the $40 fee refunded.
   (B)   Any person electing to do his own resurfacing must use class one, hot-mixed, hot-laid blacktop (minimum compacted thickness of two inches); except in extremely cold weather, when hot-mix is not available, then cold-mix may be used (minimum thickness of four inches).
   (C)   If the city resurfaces the ditch, the person making the opening shall be charged, in addition to the aforementioned $40 fee, a fee of $2 for each additional foot over 20 feet in length. Upon the completion of the resurfacing the Director of Streets shall notify the Director of Finance if any such additional fee is owed.
