For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
APPROVED INCINERATOR. An incinerator which complies with all current regulations of the responsible local, state and federal air pollution control agencies.
ASHES. Residue from fires used for cooking and for heating buildings.
BULKY RUBBISH. Non-putrescible solid waste consisting of combustible and/or non-combustible waste materials (including, but not limited to, appliances) from business, commercial, industrial and institutional establishments which are either too large or too heavy to be safely and conveniently loaded in standard solid waste packer vehicles by solid waste collectors, with the equipment available.
CENTRAL BUSINESS DISTRICT. The geographical area in which all buildings are adjacent to and located within an area bounded by Water Street from Lancaster Avenue to Collins Street, Collins Street from Water Street to Irvine Street, Irvine Street from Collins Street to Church Street, Church Street to Main Street and Lancaster Avenue between Main Street and Water Street.
CITY. The City of Richmond, Kentucky.
COLLECTION. Removal of solid waste from the designated pick up location to the transportation vehicle.
DEMOLITION AND CONSTRUCTION WASTE. Waste materials from the construction or destruction of industrial, institution, business, or commercial structures.
DIRECTOR OF FINANCE. The Director of Finance shall be the Finance Director for the city.
DIRECTOR OF SANITATION. The Director of the Solid Waste Management Program of the city shall be the Director of Sanitation for the city.
DISPOSABLE SOLID WASTE CONTAINER. Disposable plastic or paper sacks with a capacity of 20 to 35 gallons specifically designed for storage.
DUMPABLE CONTAINER. A metal tank designed or intended to be mechanically dumped into a front end loading or packer-type garbage truck.
GARBAGE. Animal and vegetable waste resulting from the handling, preparation, cooking and serving food, paper and other kitchen type waste. GARBAGE originates primarily in home kitchens, and also may originate in stores, markets, restaurants, hotels and other places where food is stored, prepared and served.
HAZARDOUS WASTE. Any waste or combination of wastes which is determined by the Kentucky Department of Environmental Protection, because of its quantity, concentration, or physical, chemical or infectious characteristics may cause or significantly contribute to an increase in mortality or any increase in serious irreversible, or incapacitating reversible, illness, or pose a substantial present or potential threat to human health or the environment when improperly treated, stored, transported or disposed of, or otherwise managed.
INSTITUTIONAL WASTE. All wastes from any producing, manufacturing or processing operation. INSTITUTIONAL WASTE shall also mean waste from schools, churches, nursing homes, courthouses and cemeteries.
MEDICAL WASTE. All medical waste generated by medical clinics, labs, hospitals, offices, or any other source shall be places in closed containers or roll carts specified for such waste and shall be disposed of at the city landfill. All infectious material or “red bag” waste shall be disposed of as prescribed by law.
OCCUPANT. Any person who, alone or jointly or severally with others, shall be in the actual possession of any dwelling unit or other any other improved real property, either as owner or as a tenant.
OFFICE. Office for the purpose of this chapter shall be classified as business establishment.
OWNER. The owners of any business or commercial establishment or representative.
PERSON. Any individual, partnership, corporation, association, joint stock company, trust estate, political subdivision or organization of any kind, or their legal representative, agent or assigns.
PRIVATE HAULER. Any person, company, partnership or corporation engaged in the storage, collection, transportation, or processing of solid waste as defined in this chapter.
PROCESSING. Incinerating, composting, baling, shredding, salvaging, compacting and other processes whereby solid waste characteristics are modified or solid waste quantity is reduced.
PUTRESCIBLE. Organic solid waste subject to decomposition by bacteria, fungi and oxidation, except trees, brush and the like not requiring daily cover.
REFUSE. Combustible trash, including, but not limited to, paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, bedding; noncombustible trash, including, but not limited to, metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, other mineral waste; street rubbish, including, but not limited to, street sweepings, dirt, leaves, catch basin dirt, contents of litter receptacles. Provided, refuse shall not include earth and wastes from building operations, nor shall it include solid wastes resulting from industrial processes and manufacturing operations such as food processing wastes, boilerhouse cinders, lumber, scraps and shavings.
ROLL CART CONTAINER. A large durable plastic refuse container on wheels, complete with attached lid. Roll cart containers are designed to be rolled to the curb by residents or proprietors to carry maximum holding capacity of 95 gallons or pounds of solid waste. Carts are designed to hold both garbage and trash. Carts are provided by the city and remain the property of the city.
SOLID WASTE. Any garbage, refuse, sludge and other discarded material, including solid, liquid, semisolid, or contained gaseous material resulting from commercial operations, and from community activities, but does not include solid or dissolved material in domestic sewage, or solid or dissolved materials in irrigation return flows or industrial discharges. BUSINESS AND COMMERCIAL SOLID WASTE is solid waste resulting from the operation of any business or commercial establishment.
SOLID WASTE COLLECTORS. Shall mean any person and/or company who collects or transports solid waste.
SOLID WASTE CONTAINER. Receptacle used by any business or commercial establishment to store solid waste during the interval between solid waste collections.
SOLID WASTE DISPOSAL. The process of discarding or getting rid unwanted material. In particular the final disposition of solid waste by man.
SOLID WASTE MANAGEMENT. The administration of solid waste activities: storage, collection, source separation, transportation, processing, treating and disposal.
STORAGE. Keeping, maintaining or storing solid waste from the time of its production until the time of its collection.
TRANSPORTATION. The transporting of solid waste from the place of collection or processing to a solid waste processing facility or solid waste disposal area.
YARD WASTES. Grass clippings, leaves, and tree trimmings.
