As used in this article:
Agency and using agency include any department, office, board, commission, or other organizational unit for which the council has line-item budgetary authority and whose affairs or funds are under the control of the council.
Bid means a statement of price, terms of sale and description of commodities or services offered by a vendor to the county.
Bidder and vendor are interchangeable terms within this article, and refer to any person or persons responding to an invitation to bid or a request for proposals.
Commodities means tangible items such as materials, supplies, or equipment.
Contractual services means technical or professional services required by the county which may include leases and lease agreements covering real property, goods, services, or combinations thereof; construction, consulting, or the providing of tangible items, such as material, supplies, or equipment. This includes, but is not limited to, any telephone, gas, water, electrical light and power services; towel, window-washing and cleaning services; the rental of equipment and machinery; and all other types of agreements under which the contractor provides services which are required by the county government but not furnished by its own employees; provided, however, that "contractual services" shall not include legal advertising, and purchases of space for legal advertising shall not be subject to the provisions of this article. Contractual services shall be governed by contract instruments under which the specified services will be provided at an agreed-upon cost for a specified period of time not to exceed a period of five (5) years.
Person means one or more individuals, partnerships, associations, corporations, mutual companies or stock companies.
Personal services are technical type repairs or service skills including, but not limited to, janitorial services, office machine repair, elevator repair, and other such services.
Request for proposals is a written or published solicitation for proposals to provide goods, services, lease agreements, or construction as described therein.
Responsible vendor includes any vendor who submits a responsive bid or request for proposal, and has furnished, when requested, information and data to prove that his financial resources, production of service facilities, service reputation and experience are adequate to make satisfactory delivery of the supplies, materials, equipment or contractual services on which he bids or submits a proposal; and who has not violated, or attempted to violate, any provisions of this article.
Responsive vendor includes anyone who submits a bid or proposal to furnish supplies, materials, equipment or contractual services in conformity with the specifications, delivery terms and conditions, and other requirements included in the invitation for bids or requests for proposals.
Service machine is any machine placed on county property by a private person which exacts payment for a service or thing.
Vendors' list means a current file of sources of supply of articles for each category of commodities repetitively purchased for county use.
