(a) New Construction. As to any new construction after the effective date of this section, any person, firm or corporation seeking a building permit to construct any building, other than single and two-family dwelling units or subdivisions, when a mechanical waste water treatment plant is to be constructed to service the waste from the building shall:
(1) Obtain written preliminary approval of the plans, specifications and discharge point from the Ohio Environmental Protection Agency.
(2) Place on file with the Director of Public Service a copy of the plans, specifications and written approval by the Ohio Environmental Protection Agency.
(3) Submit an executed copy of a contract, between the owner of the real property upon which the building and waste water treatment plant is to be constructed, and a licensed State of Ohio waste water treatment plant operator, providing for the maintenance and repair of the plant until its use can be discontinued, and connection is made to the Village sanitary sewer system.
(4) Submit an executed copy of a contract with a licensed State of Ohio waste water treatment operator providing for daily, weekly or monthly inspection of the waste water treatment plant. The contract shall be in such form as determined by the Director of Law and approved by Council, and shall be binding upon the heirs and assigns of the owner.
(b) Existing Buildings and Buildings with Building Permits. As to existing buildings, buildings under construction or buildings contemplated for which a building permit has been issued, on and after September 1, 1972, any person, firm or corporation owning or operating an existing building or structure, a building or structure under construction, and any person, firm or corporation contemplating building a building or structure for which a building permit has been issued as of the effective date of this section, other than a single or two-family dwelling unit or subdivision, wherein or whereon or in connection with which a mechanical waste water treatment plant is used to service such building or structure shall:
(1) Obtain preliminary written approval of the plans, specifications and discharge point from the Ohio Environmental Protection Agency.
(2) Place on file with the Director of Public Service a copy of the plans, specifications and written approval by the Ohio Environmental Protection Agency.
(3) Submit an executed copy of a contract, between the owner of the real property upon which the building and waste water treatment plant is to be constructed, and a licensed State of Ohio waste water treatment plant operator, providing for the maintenance and repair of the plant until its use can be discontinued, and connection is made to the Village sanitary sewer system.
(4) Submit an executed copy of a contract with a licensed State of Ohio waste water treatment operator for daily, weekly or monthly inspection of the waste water treatment plant.
