(a) Pursuant to Ohio R.C. 727.44, a district is hereby established to be known as Sewer District No. 5. A legal description of Sewer District No. 5 is attached to Ordinance 68-1993 as Exhibit “A” and incorporated herein fully as if by reference.
EDITOR’S NOTE: Pursuant to Ordinance 72-2004 Sewer District No. 5 was amended to include an 45.33 acre parcel on the south side of Wheatley Road at the corner of Revere Road to Sewer District No. 5.
(b) Council hereby adopts and approves the general plans heretofore prepared by the Village Engineer, together with the amendments and corrections shown thereon, on file with the Clerk of Council, for sewerage of Sewer District No. 5 as established by subsection (a) hereof.
(c) All sewer design and construction for Sewer District No. 5 will be such that the system will be adequate to service the whole system when the whole development is complete. The cost to correct any repairs due to improper design or construction will be the responsibility of the developer. (Ord. 68-1993. Passed 6-21-94.)
