Pursuant to Ohio R.C. 727.44 a district is hereby established to be known as Sewer District No. 1 which is described as follows:
Beginning at a point at the center of the intersection of Brecksville Road and Wheatley Road; thence easterly to the west boundary of I-77; thence southerly along the westerly boundary of I-77 to the centerline of Everett Road; thence westerly along the centerline of Everett Road to the centerline of Brecksville Road; thence westerly along the centerline of Everett Road, a distance of 500 feet; thence northerly parallel to Brecksville Road to the centerline of Broadview Road; thence southeasterly along the centerline of Broadview Road to the place of beginning.

Beginning in the original centerline of old Wheatley Road formerly sixty feet wide and now widened, at its intersection with the original centerline of the County Highway 17, otherwise known as Cleveland-Massillon Road formerly 66 feet wide, such point being in the westerly line of original Richfield Township Lot No. 3 at the southwest corner of Parcel No. 4 of lands conveyed to Gordon A. Stouffer and Vernon A. Stouffer by deed recorded in Volume 1904 Page 151 of Summit County Deed Records, thence north 89 degrees, 08 minutes, 24 seconds east along the original centerline of Wheatley Road and the southerly line of lands so conveyed to Stouffer a distance of 400.01 feet to the easterly corporate boundary of the Village of Richfield and the principal place of beginning of the premises herein described;
Thence north 0 degrees, 12 minutes, 46 seconds west along the easterly corporate boundary of the Village of Richfield, and crossing the northerly right-of-way line of Wheatley Road at a distance of 130.00 feet, a total distance of 1267.93 feet to the southerly line of lands conveyed to the State of Ohio by deed recorded in Volume 5158 Page 314 of Summit County Records;
Thence north 55 degrees, 18 minutes, 17 seconds east along the southerly limited access line of 1-271 a distance of 644.89 feet to an angle therein;
Thence north 57 degrees, 30 minutes, 45 seconds east along such southerly line a distance of 369.67 feet to an angle therein;
Thence south 89 degrees, 08 minutes, 24 seconds west along the original centerline of Old Wheatley Road a distance of 2214.99 feet to the place of beginning and containing within such bounds 105.287 acres of land be the same more or less but subject to all legal highways.

There is hereby exempted from Sewer District 1 a parcel owned by the Estate of Fred D. McNair, recorded at Volume 4305, Page 602 of the Summit County Recorder’s Office being Permanent Parcel 50-00845 and 01842.
The foregoing parcel shall not be assessed for the sewerage improvements to be constructed in Sanitary Sewer District No. 1 and the foregoing parcel may not utilize the sanitary sewer improvements in Sewer District No. 1 unless and until the property owner petitions Council to be reincluded in Sanitary Sewer District No. 1. Council accepts the petition to include the parcel in Sanitary Sewer District No. 1. The property owner shall pay the tap-in fee or fees in accordance with Chapter 926
(Ordinance 5-1991) without interest in a lump sum.
