521.13 YARD WASTE COMPOSTING SITES.
   (a)   Council hereby establishes guidelines for the construction, erection, and maintenance of individual yard waste composting sites within the City.
   (b)   A permit shall be obtained prior to the construction or erection of any and all yard waste composting sites.
   (c)   Prior to issuance of a permit, individual yard waste composting site plans must be submitted to the Architectural Board of Review for approval.
   (d)   Each application for permit by the Architectural Board of Review shall be accompanied by a fifteen dollar ($15.00) fee.
   (e)   No composting site shall exceed six foot by six foot by three foot (above ground) and a maximum one foot below ground. Each such site shall be completely surrounded by shrubbery no less than 3/4 of the height of the structure to shield such site from view.
   (f)   Compost sites shall be located directly behind the house on such property and shall be no less than ten feet from any property line and no less than ten feet from the rear of the home.
   (g)   No composting site shall be permitted to interfere with the flow of any waterway, and shall not be constructed or erected nearer than two feet from any draining ditch.
   (h)   No composting site shall be constructed or erected in a flood plain nor in any area that ponds and shall be permitted only in areas that have sufficient drainage.
   (i)   Permitted materials to be placed in each individual compost site shall include yard waste only (grass, leaves, tree and bush clippings, weeds).
   (j)   The use of chemical for a compost breakdown shall be in conformance with regulations enacted by the County of Summit.
   (k)   Any person or officer deeming himself or itself adversely affected by this section or decision of the Building Inspector or Architectural Board of Review may appeal such decision to Council within ten days after such adverse decision.
   (l)   The Building Inspector shall inspect and enforce all of the provisions of this section in order to safeguard the health, welfare, and safety of the public. The Building Inspector is authorized to enter onto the property at any reasonable time for the purpose of making inspections and performing duties under this section.
   (m)   The Building Inspector shall issue all necessary notices and orders to abate illegal or unsafe conditions to insure compliance with the requirements of this section for the health, safety, and welfare of the public.
   (n)   Violations of the provisions of this section or failure to comply with any other requirements set forth herein shall constitute a minor misdemeanor. Any person who violates this section or fails to comply with any of its requirements shall upon conviction be fined as provided by the laws of the City of Reminderville. Each day such violation continues shall be considered a separate offense.
   (o)   Nothing herein contained shall prevent the City from taking such other lawful action as is necessary to prevent or remedy any violation.
