(a) A temporary installation of an above-ground storage tank not to exceed 500 gallon capacity, for flammable, combustible or hazardous liquids, may be permitted by special permit from the Fire Department. The temporary tank must meet NFPA 30 requirements. The temporary tank permit is good for a maximum of sixty (60) days, and extensions may be granted by the Fire Department for a time period to be determined by the Fire Department.
(b) A private owner may apply for a permit to permanently install an above-ground storage tank for flammable, combustible or hazardous liquids. The application for a permanent tank must be made to the Planning and Zoning Commission, and plans must comply with the following requirements of the Fire Department and the Building Department:
(1) Only vaulted tanks are permitted.
(2) The tank must meet or exceed NFPA 30, 30A, 31 and 70 requirements.
(3) The tank must meet or exceed UL 2085 requirements.
(4) The Fire Department will determine the type of crash protection individually by site.
(5) Vaulted tanks must have interstitial space leak detection with audible and visual alert.
(6) The tank area is to be surrounded by a concrete block wall one foot higher than the top of the tank. The style of block shall be determined by the Building Department. The opening in the wall for access shall be no wider than four feet and have a noncombustible gate with a lock. No drains are permitted in the enclosure.
(7) The above-ground storage tank owner shall provide the Fire Department with enough foam to fight a fire involved with the tank. The amount and type of foam is to be specified by the Fire Department.
(8) The tank must be installed on concrete pads only as specified by the Building Department.
(9) The proposed site must be approved by the Fire Department.
(10) The anchoring of the tank is required as specified by the manufacturer.
(11) The tank is to be installed in an industrial area only.
(12) The tank may only be installed with a minimum buffer area of 150 feet from any residential area.
(13) For permanent tanks not to exceed 2,000 gallons, there shall be a minimum buffer area of 150 feet from any residential area.
(14) For permanent tanks with a capacity of more than 2,000 gallons, but not more than 10,000 gallons, only diesel fuel or liquid with a flashpoint equal to or greater than that of diesel fuel may be stored, with the following additional requirements:
A. If the capacity of the permanent tank is more than 2,000 gallons, but not more than 4,000 gallons, there shall be a minimum buffer area of 250 feet from any residential area.
B. If the capacity of the permanent tank is more than 4,000 gallons, but not more than 6,000 gallons, there shall be a minimum buffer area of 350 feet from any residential area.
C. If the capacity of the permanent tank is more than 6,000 gallons, but not more than 8,000 gallons, there shall be a minimum buffer area of 450 feet from any residential area.
D. If the capacity of the permanent tank is more than 8,000 gallons, but not more than 10,000 gallons, there shall be a minimum buffer area of 550 feet from any residential area.
E. Tanks with capacity more than 6,000 gallons require a variance from the Ohio Fire Marshal.
