(a) Whoever violates any of the provisions of NFPA 101, as adopted above, or fails to comply therewith, or violates or fails to comply with any order made thereunder, or builds in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or fails to comply with such an order as affirmed or modified by the Board of Zoning Appeals, within the time fixed herein, is guilty of a misdemeanor of the first degree and shall severally, for each and every such violation or noncompliance respectively, be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both. The imposition of a penalty for a violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violation or any defect within one day. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
(b) The application of the penalty herein provided for shall not be held to prevent the enforced removal of prohibited conditions.
