The applicant may appeal, in whole or in part, any ruling to the full Council of the City of Reminderville. (Notice of Appeal must be filed with the City Clerk within thirty days of a final ruling by the Planning and Zoning Commission.) The Notice of Appeal must state with reasonable particularity the grounds for the appeal, the legal basis for the appeal, including the citation of statutory authority, legal opinions and Attorney General opinions and the relief sought therein. After the filing of the Notice of Appeal with the City Clerk, the hearing shall be scheduled within a period of ninety days.
(a) A notice of the hearing on the appeal before Council shall be posted in a newspaper of general circulation in the area, at least thirty days prior to the hearing.
(b) A notice of the hearing on the appeal shall be mailed to the applicant, all contiguous and adjacent landowners and the owner of the land at the address given in the application not less than thirty days prior to the public hearing, excluding the day of the mailing and including the day of the hearing on the appeal.
(c) The hearing on the appeal shall be open to the public and shall continue from day to day until all parties, including the public, have had an opportunity to state their case, their objections and concerns.
(d) At any time during the hearing the Mayor and/or Council may ask questions of the Applicant or any interested party. At the conclusion of the hearing on the appeal, Council shall immediately take a public vote on whether to affirm, reverse, remand for further consideration and/or recommendations to the Planning and Zoning Commission or to affirm or reverse with additional conditions or considerations.
