937.07 ISSUANCE OF PERMIT.
   The Planning and Zoning Commission shall determine that all of the information required herein has been provided for review and that all local, county, state, federal, governmental and quasi-governmental permits have been obtained. They will insure that there are no deed restrictions or any other restrictions upon the proposed use of any land and if legally binding restrictions are found, they shall not grant a permit. A legal opinion from the City Solicitor or by way of Declaratory Judgment may be obtained. If the Planning and Zoning Commission finds that noxious odors will not be emitted, that City streets and property will not be damaged, that downstream property owners and proper owners adjacent to or contiguous to the proposed construction site will not be adversely affected by flooding, storm water run-off, erosion, or other water related damage and that the granting of the application will not adversely affect the public welfare, peace, health, safety and convenience, it shall grant the application with such conditions relating to the method of grading, excavating, cutting, clearing, thinning, filling or removal of the land, or with conditions relating to the construction or the operations that are to be conducted or conditions relating to storm water management and drainage, before or after the completion of the proposed construction and such other conditions which the Planning and Zoning Commission may reasonably impose. All rulings and findings by the Planning and Zoning Commission shall be in writing.
   (a)   The Planning and Zoning Commission shall make a determination as to whether the granting of a building permit will have any adverse effect on the City of Reminderville. If the Planning and Zoning Commission determines that the City of Reminderville's needs for its future growth will be in any way comprised by the issuance of a permit, then the Planning and Zoning Commission will not issue a building permit for such building, erecting, constructing, reconstructing, enlarging, changing or maintaining any utility, building, plant, disposal system, water treatment plant, or sanitary sewage collection system.
