(a) The application, along with all of the documents collected by the City Engineer, shall be forwarded to the Planning and Zoning Commission, together with a written report from him and the recommendations thereon.
(b) The Planning and Zoning Commission may request a report from the Summit County Soil and Water Conservation District, stating their recommendations for adequate erosion and sediment control measures, for the grading and excavation of the premises surrounding the proposed building site and for all properties that pipelines or conduits, pumping stations, and force mains, and all other construction, devices, appurtenances and similar facilities may be placed upon. (Any fees incurred shall be borne by the applicant.)
(c) The Planning and Zoning Commission shall insure that all federal, state, county, and local permits may be required are obtained. Those permits may include, but are not limited to, permits from the Army Corp. of Engineers, Ohio EPA, United States EPA.
(d) The Planning and Zoning Commission shall insure that there are no restrictions on any of the properties that are going to be utilized for the proposed construction, including those properties that contain pipelines, conduits, pumping stations, force mains, etc.
(e) The Planning and Zoning Commission shall insure that there are no previous agreements between parties and/or governmental agencies and/or developers, that would restrict the manner in which any of the properties to be utilized for construction, including pipelines, conduits, pumping stations, and force mains or other construction, devices, appurtenances, etc. may be built upon or used.
(f) The Planning and Zoning Commission shall insure that the roadways within the City that will be utilized for construction and/or utilized by trucks and other equipment for the disposal of sewage, waste products, excrementious, or other discharge, will not contain loads that will cause destruction or damage to City roadways.
(1) The Planning and Zoning Commission may require the applicant to post a bond, not to exceed fifty thousand dollars ($50,000) for damage that may be caused to City streets and/or property.
(2) The Planning and Zoning Commission may also set reasonable limits on the size and weight of trucks. In order to determine reasonable limits the applicant shall first provide the Planning and Zoning Commission with the proposed routes to be used for ingress and egress.
