2-1-9: SIGNS AND AWNINGS:
   A.   Awnings: All awnings heretofore erected, or to be erected in place of those now existing and attached to buildings, shall be at least seven and one-half feet (71/2') at the lowest part thereof above the top of the sidewalk and shall be supported without posts, but by iron brackets or by an iron framework attached firmly to the building so as to leave the sidewalk wholly unobstructed and all awnings heretofore erected or constructed in a different manner and in any way obstructive to the public use of travel on the sidewalks, shall be removed within ten (10) days after notice in writing given by the authority of the village board and personally served on the owner or occupant of the building to which such awning is attached.
   B.   Signs: No person shall place or hang any sign or cause the same to be hung over any sidewalk without the written permit of the village board. No permit shall be granted for the placing or hanging of any sign where the distance from the bottom of the sign to the sidewalk shall be less than nine feet (9').
No permit shall be granted for the placing or hanging of any sign which protrudes fifteen inches (15") or less from the building to which it is fastened, where the distance from the bottom of the sign to the sidewalk shall be less than nine feet (9').
   C.   Permit Required: No porch, gallery, store, platform, entrance to basement, fire escapes, downspout, railing or grating shall be allowed to extend into, upon or over any sidewalk without the written permit of the village board. (1981 Code)
   D.   Regulating Outdoor Advertising: No person shall erect or display any outdoor advertising or sign, except in conformance with the provisions of this subsection.
      1.   Definitions:
          ADVERTISING: Shall include, but not be limited by this enumeration, any outdoor sign, billboard, poster panel, or structure of any kind, including the signs of buildings, upon which is displayed, or painted, or otherwise depicted in any way, information, announcements, notices or other art which calls, or is intended hereby to give the word "advertisement" its broadest general meaning.
         SIGN: Any outdoor advertising sign, display, device, notice, figure, painting, drawing, message, placard, poster and billboard, or other structure on which an advertisement is placed which is designed, intended or used to advertise or inform, so long as any part of the advertising or informative contents are visible from any place on any village street.
      2.   Zoning Use Classifications: When used herein, the terms "residence districts", "business districts" and "industrial districts" shall mean the designations given to such terms in the zoning regulations of the village, that are contained in the village zoning ordinance 1 .
      3.   Permits Required: No sign shall be placed within the village until the owner of the property upon which it is to be erected shall have first obtained a village permit therefor from the village clerk, upon payment of a fee of one hundred dollars ($100.00).
      4.   Sign Prohibited: No sign shall be erected or maintained within any residence districts, except for the following:
         a.   Directional or other official signs, including, but not limited to, signs pertaining to natural wonders, scenic and historical attractions, not exceeding ten feet (10') in square foot area.
         b.   On premises signs advertising home activities conducted on the property on which they are located, so long as they do not exceed one square foot.
         c.   Signs advertising the sale or lease of the property upon which they are located.
         d.   The signs permitted in subsections D4a, D4b and D4c of this section shall be constructed in such fashion and maintained in such manner as to be aesthetically pleasing and in keeping with the general construction within the area in which they are placed. The interpretation and the appropriateness of such signs shall be left to the Director of the Public Works, and any person aggrieved by the determinations of such official may appeal such determination direction to the village board, and the findings of the village board shall be final. The size, coloring and lighting of such signs shall be within the regulations.
      5.   Signs Permitted: Any sign or advertisement may be erected within the business and industrial districts of the village, but only upon petition to the village board for a permit to erect such sign or advertisement. The determination of the village board upon such petition shall be based upon the following criteria:
         a.   Size Of Signs:
            Maximum area shall not exceed one thousand two hundred (1,200) square feet.
            Maximum area shall not exceed thirty feet (30').
            Maximum length shall not exceed fifty feet (50').
            The size limitations shall apply to each side of a sign structure.
         b.   Spacing Of Signs:
            (1)   No more than two (2) signs shall be permitted on any lot nor closer than one hundred feet (100') apart, whichever is less.
            (2)   Signs larger than ten (10) square feet shall not be constructed one above the other.
         c.   Illumination Of Signs:
            (1)   All signs shall be effectively shielded so as to prevent rays of light from being directed at any portion of the village streets, and which are of such intensity of brilliance as to cause glare or otherwise impair the vision of the driver of any motor vehicle upon the village streets.
            (2)   No signs shall be so illuminated so as to interfere with the effectiveness or obscure any official traffic sign, device or signal.
            (3)   No flashing, intermittent or moving light or lights shall be permitted unless the same are of the nature which gives public service information, time, date, temperature, weather or similar information.
         d.   Setbacks: All signs shall conform with the setback requirements of the zoning ordinance 2 of the village. No sign shall be allowed on or to overhang highway right of way.
         e.   Official Sign Resemblance: No sign shall be erected or maintained which imitates or resembles an official traffic sign, signal or device.
         f.   Architectural Conformity: The sign shall be so constructed so as to be in keeping with the architectural design of the other structures within the area in which it is to be placed.
      6.   Federal, State And County Highways: Signs on federal, state and county highways within the village shall conform with federal, state and county laws affecting the same as well as local ordinances.
      7.   Natural Objects As Signs: No sign shall be erected or maintained upon trees, or painted or drawn upon other natural features within the village.
      8.   Sign Maintenance: Signs shall not be erected nor maintained which are structurally unsafe or in substantial disrepair.
      9.   Nuisances: Any sign or advertising erected without the permit herein required or which do not conform to this subsection are declared to be a nuisance.
      10.   Exemptions: Exempted from this subsection are all "on premises" signs. Such are defined to be those located on the premises of the advertised activity and within fifty feet (50') of such activity.
      11.   Nonconforming Signs: Any sign not now in conformance with the herein regulations shall be permitted to be maintained for a period of two (2) years (until January 1992), within which time said sign shall be brought within compliance and failing to do so upon the termination of said two (2) year period, the village board shall exercise its police powers to obtain such conformity or removal of such nonconforming sign.
      12.   Other Advertising Material: No signs, posters or other advertising material shall be placed in or on any village owned property without permission from the department of public works director.
