ORDINANCE NO. 2020 - 2
AN ORDINANCE TO AMEND ORDINANCE NO. 2006-5
PERTAINING TO THE WATER UTILITY OF
THE VILLAGE OF REEDSVILLE, WISCONSIN
WHEREAS, the village of Reedsville, Wisconsin, is currently processing a grant and loan for upgrades to the village of Reedsville water utility (“new financing”); and
WHEREAS, the new financing is in addition to existing financing provided by the USDA acting through the Farmers Home Administration in 2006; and
WHEREAS, the village Board adopted Ordinance No. 2006-5 with respect to the existing financing requirements and intends to amend and update Ordinance No. 2006-5 to be consistent with the new financing project;
NOW, THEREFORE, the Village Board of the village of Reedsville, Wisconsin, pursuant to its police powers, hereby amends Ordinance No. 2006-5 which establishes the Water Utility of the Village of Reedsville, and water rates, rules and regulations concerning the government thereof, and other matters and penalties, and hereby ordains as follows:
Section 1.01 of Ordinance No. 2006-5 is amended to add the following:
As used in this ordinance, the term “Village” means the village of Reedsville, Wisconsin, and the term “Village Board” means the trustees of the village of Reedsville, Wisconsin.
Section 3.05 Installation of House Laterals, section (A) is repealed, and substituted therefor the following:
A. All water lines on private property, whether underground or within a structure, will be installed in accordance with Wisconsin Administrative Code provisions SPS 380-387 as regulatory guidelines for the construction, installation, supervision and inspection of plumbing.
Section 3.10 Penalty for Improper Use, sections (B) and (C) are amended as follows:
B. Cross-connections are not permitted between the water utility system and any other source of water as set forth in Wisconsin Administrative Code Section SPS 382.41.
C. All private wells which are unused, unsafe, or do not comply with applicable Wisconsin Administrative Code provisions shall be abandoned in compliance with Section NR 812.26 of the Wisconsin Administrative Code.
4. Section 3.12 Penalties (A) is amended to delete the amount of forfeiture of not less than $10.00 nor more than $200.00, and substitute therefor the amount of forfeiture shall be not less than $200.00 nor more than $500.00 plus the costs of prosecution.
5. Section 4.01 Charges are a Lien on Property is amended to revoke Section 66.069(1) and substitute therefor Sections 66.0809 and 74.01 Wis. Stats.
Except as herein amended, Ordinance No. 2006-5 is hereby ratified and affirmed.
