A. The city council shall hear the appeal at its next regular meeting following a period of ten (10) days after the filing of the appeal. The city council may affirm, reverse or modify a decision of the board on a variance application, provided that if a decision denying a variance is reversed or a decision granting a variance is modified, the city council shall, on the basis of the record transmitted and such additional evidence as may be submitted, make the findings prerequisite to the granting of a variance as prescribed in subsections 10-21-7A and B of this chapter, when applicable.
B. A variance which has been the subject of an appeal to the city council shall become effective immediately following the date on which the variance is granted by the city council. (Ord. 622, 9-2-1980)
