(A) Penalty. The penalty for violation of any of the provisions of this chapter shall be a misdemeanor.
(B) Subsequent offenses. Nothing in this section prohibits the city from seeking prosecutions as a misdemeanor for an alleged second violation of this chapter by a person 21 years of age or older within five years of a previous conviction under the chapter.
(C) Immunity clause. A person under 21 years of age who purchases or attempts to purchase edible cannabinoid products while under the direct supervision of a responsible adult for training, education, research, or enforcement purposes which have been approved by the city manager or his designee shall not be subject to a criminal penalty.
