§ 71.03 OPERATION.
   Except as otherwise herein permitted, it is unlawful for any person to operate a snowmobile, all-terrain vehicle or golf cart vehicle not licensed as a motor vehicle as follows:
   (A)   On State Highway #32 inside the city limits unless crossing said highway at a 90-degree angle or during an emergency as herein otherwise provided;
   (B)   On the portion of any right-of-way of any street used for motor vehicle travel, except that a snowmobile, all-terrain vehicle, recreational on-road vehicle or golf cart may operate upon the most right-hand lane of a street and may in passing or making a left-hand turn operate on other lances which are used for vehicle traffic in the same direction;
   (C)   On all public sidewalks provided for pedestrian travel, except to cross the same at a 90-degree angle. Excluding licensed ATV, ROV and licensed golf carts on the sidewalk between Oak Knolls golf course and Dow Avenue SE;
   (D)   On boulevards within any public right-of-way, except where sign-posted and designated pursuant to resolution of the Council;
   (E)   On the private property of another without specific permission of the owner or person in control of the property;
   (F)   At a rate of speed greater than 15 mph, and in no event greater than reasonable or proper under all surrounding circumstances;
   (G)   At any place in a careless, reckless or negligent manner or heedlessly in disregard of the rights or safety of others or in a manner so as to endanger or be likely to endanger or cause injury or damage to any person or property;
   (H)   So as to tow any person or thing except through use of a rigid tow bar attached to the rear of the snowmobile or all-terrain vehicle;
   (I)   At any place while under the influence of alcohol or drugs as defined in M.S. §§ 169A.20, 84.87, 84.928 and 84.91, as they may be amended from time to time, which are incorporated herein by reference; or at any place while having an open container of alcohol as defined in M.S. § 169A.35 Subd. 3, as it may be amended from time to time;
   (J)   Within 50 feet of any pedestrian, fisherman, skating rink or sliding area where the operation would conflict with the safe use of, or endanger other persons or property;
   (K)   Except while traveling in a direct route to a public or private area where operation is unrestricted except as to requirements of state statutes. This limitation shall not be construed to prevent the use of snowmobiles or all-terrain vehicles and recreational on-road vehicles to travel to and from the driver’s place of employment, or for all-terrain vehicles licensed under § 71.13 as an alternative mode of transportation and or for snow removal; or for golf carts licensed under § 71.14 as an alternative mode of transportation;
   (L)   Snowmobiles and ATVs and ROVs must have front and rear lights being lit at all times while on public streets;
   (M)   For all-terrain vehicles, recreational on-road vehicles and golf carts, on any portion of the bike path excluding the area between First Street and Harren Drive, which shall be open for licensed ATV, ROV and licensed golf cart travel;
   (N)   All operators must yield to all oncoming pedestrian traffic on the bike path by pulling to the right shoulder and stopping;
   (O)   All operators overtaking and passing a pedestrian on the bike path must do so in a slow and safe manner at speeds no greater than five mph;
   (P)   All operators must come to a complete stop and allow pedestrians to safely cross the bridge before proceeding onto the railroad bridge between Harren Drive and First Street; or
   (Q)   For all-terrain vehicles, recreational on-road vehicles and golf carts after sunset and before sunrise or in inclement weather or when visibility is impaired by weather, smoke, fog or other conditions, or at any time when there is insufficient light to clearly see persons and vehicles on a roadway at a distance of 500 feet.
