§ 2.65 BIDDING PROCEDURES; DISPENSATION.
   The bidding procedures set forth in this article may be dispensed with by the Purchasing Officer, with the approval of the City Manager, when it is determined that:
   (A)   An emergency exists pursuant to the provisions of Chapter 6 of this code requiring purchases to be made with the nearest available source of supply;
   (B)   When it is established to the satisfaction of the Purchasing Officer that the supplies, services, equipment or public works projects can be obtained only from one vendor or contractor;
   (C)   Subject to the approval of the City Council, the supplies, services, equipment or public works projects, including but not limited to the items as communications systems, traffic signals, parking meters and the like, have been uniformly adopted or otherwise standardized due to the needs of the city for systems uniformity, effective maintenance, cost effectiveness or similar purposes;
   (D)   The equipment being purchased or leased consists of one or more used vehicles;
   (E)   The purchase of professional, consulting or technical services, so long as funds for the purchases have been appropriated in the annual budget and the purchases are made in accordance with policies and procedures approved by the City Manager as set forth in the city's Administrative Policies and Procedures Manual, so as to ensure that the services needed are acquired in a fair and equitable manner in the best interests of both the city and the service providers;
   (F)   The purchase of insurance and services related thereto, including but not limited to insurance adjusting services, so long as funds for the purchases have been appropriated within the annual budget; (If an existing appropriation for the purpose is insufficient, or a new appropriation therefor as required, the Purchasing Officer shall have authority to bind a coverage or provide for the services until the required appropriation has been approved.)
   (G)   The purchase of materials, supplies or services from public or private nonprofit state corporations operating workshops serving the handicapped, so long as funds for the purchases have been appropriated within the annual budget;
   (H)   The purchase of supplies, services, equipment and public works projects through a cooperative purchasing program with another state or local governmental agency, so long as funds for the purchases have been appropriated within the annual budget;
   (I)   Purchases of supplies, services or equipment where the price for such are regulated by a federal or state regulatory agency;
   (J)   Interest and principal payments on long-term debt of the city;
   (K)   Software maintenance, and continuation of Software-as-a-Service (SAAS) Contracts; and/or
   (L)   Land purchases approved by the Council.
