Whenever the words dwelling, dwelling unit, rooming unit, premises and structure are used in this Code, they shall be construed as though they were followed by the words or any part thereof. Words used in the singular include the plural, and words used in the plural include the singular. The masculine gender includes the feminine, and the feminine the masculine. The word shall is mandatory; the word may is directory. In addition:
(1) Approved manner means a manner which is in accordance with existing requirements of the City of Ravenna.
(2) Basement means that portion of a building which is partly or completely below grade.
(3) Central heating system means the heating system permanently installed so as to provide the distribution of heat to all habitable rooms.
(4) Deterioration means the condition or appearance of the exterior of a building or part thereof, characterized by holes, breaks, rot, crumbling, cracking, peeling, rusting or other evidence of physical decay, neglect or lack of maintenance.
(5) Dilapidated means no longer adequate for the purpose or use for which it was originally intended and in need of repair.
(6) Dwelling means any enclosed space wholly or partly used or intended to be used for living, sleeping, cooking and eating, provided that temporary housing, as hereinafter defined, shall not be classified as a dwelling. Industrialized housing and modular construction which conform to the Ohio standards and used or intended for use for living, sleeping, cooking and eating purposes shall be classified as dwellings. (See also Structure.)
(7) Dwelling unit means a room or group of rooms located within a dwelling and forming a single habitable unit with facilities used or intended to be used by a single family for living, sleeping, cooking and eating purposes.
(8) Egress means an arrangement of exit facilities to assure a safe means of exit from a building.
(9) Exterior of the premises means those portions of a building which are exposed to public view and the open space of any premises outside of any building.
(10) Extermination means the control and elimination of insects, rodents or other pests by eliminating their harborage places; by removing or making inaccessible materials that may serve as their food; or by poisoning, spraying, fumigating or trapping.
(11) Family means one or more persons related by blood, adoption or marriage, living together as a single housekeeping unit, exclusive of household servants; or a number of persons, not exceeding two, living together as a single housekeeping unit and not related by blood, adoption or marriage.
(12) Foundation means that portion of a structure, below or partially below grade, which provides support for exterior walls and other structural parts of a building.
(13) Garbage means the animal and vegetable waste resulting from the handling, preparation, cooking, serving and consumption of food.
(14) Habitable room means a space in a structure for living, sleeping, eating or cooking. Bathrooms, toilet compartments, closets, halls, storage or utility space and similar areas are not to be considered habitable space.
(15) Housing Code or this Code means the Housing and Property Maintenance Code of the City of Ravenna, adopted by Ordinance 1992-16, passed April 6, 1992, and codified as Title Eight of Part Fourteen - Building and Housing - of these Codified Ordinances of Ravenna.
(16) Infestation means the presence within or around a dwelling of any insects, rodents or other pests.
(17) Kitchen means any room having a floor area of sixty square feet or more and used for the storage and preparation of foods and containing the following equipment: a sink or other device for dish washing, a stove or other device for cooking, a refrigerator or other device for cool storage of food, cabinets and/or shelves for storage of equipment and utensils, and a counter or table for food preparation.
(18) Kitchenette means any small kitchen or an alcove containing cooking facilities, which has a floor area of less than sixty square feet.
(19) Lead-based paint means any paint containing more lead than the level established by the U.S. Consumer Product Safety Commission as being the safe level of lead in residential paint and paint products.
(20) Nonresidential dwelling unit means a structure in which no one lives.
(21) Occupant means any person living and sleeping in a dwelling unit or having actual possession of such dwelling unit or any person who leases or rents a nonresidential building, structure or any portion thereof.
(22) Operator means any person who has, or has been designated to have, charge, care or control of a structure or premises, which are let or offered for occupancy.
(23) Owner means any person who, alone or jointly or severally with others:
A. Has legal title to any premises, dwelling or dwelling unit, with or without accompanying actual possession thereof; or
B. Has charge, care or control of any premises, dwelling or dwelling unit, as owner or agent of the owner or as an executor, administrator, trustee or guardian of the estate of the owner. Any such person thus representing the actual owner shall be bound to comply with the provisions of this Code to the same extent as if he or she were the owner.
(24) Person includes any individual, corporation, association, partnership, trustee, lessee, agent or assignee.
(25) Plumbing includes the practice, materials and fixtures used in the installation, maintenance, extension and alteration of all piping, fixtures, appliances and appurtenances in connection with the drainage systems, vent systems and the water-supply venting systems within or adjacent to any building, structure or conveyance. Plumbing also means the practice and materials used in the installation, maintenance, extension or alteration of the storm water, liquid waste, drainage and water supply systems of any premises.
(26) Premises means a platted lot or part thereof or an unplatted lot or parcel of land or plot of land, either occupied or unoccupied by any dwelling or nondwelling structure, and includes any building, accessory structure or other structure thereon.
(27) Rehabilitation means the restoration of a structure or dwelling unit to a satisfactory physical condition which meets all of the requirements of this Code.
(28) Rooming house means any dwelling other than a hotel or motel, or that part of any dwelling, containing one or more rooming units, in which persons are housed, either individually or as families, with or without meals provided.
(29) Rooming unit means any room or group of rooms forming a single habitable unit used or intended to be used for living and sleeping, but not for cooking purposes.
(30) Rubbish means any combustible and noncombustible waste material, except garbage, and includes the residue from the burning of wood, coal, paper, rags, rubber, leather, tree and yard trimmings, metals, glass and other like materials.
(31) Structure means any building constructed to serve any purpose, occupied or not occupied, with a permanent foundation.
(32) Substandard condition means premises that fail to comply with one or more of the provisions of this Code.
(33) Supplied means paid for, furnished by, provided by, or under the control of an owner, operator or agent.
(34) Temporary housing means any tent, trailer, mobile home or other structure used for human shelter, which is designed to be transportable and which is not attached to the ground, to another structure or to any utility system on the same premises for more than thirty consecutive days.
(35) Words not specifically defined in this Code shall have the common definition set forth in a standard dictionary.
