(a) All owners of abutting lots shall keep necessary sidewalks in repair within the limits of the City.

(b) Whenever the Director of Public Service finds that a necessary sidewalk or part thereof within the corporation limits is in need of repair, he or she shall issue a notice to the owners of abutting lots or land to repair the sidewalk within fifteen days from the time of service or publication of the notice. The notice shall specify the nature of repairs required and shall state, further, that if the notice is not complied with within the time specified, the Director of Public Service will cause the repairs needed to be made and will charge the cost to the owners of the lands abutting the sidewalk, and that upon the completion of the work, or within thirty days thereafter, the expense shall be paid to the Finance Director. If the cost is not paid, the expense will be certified for collection, together with a five percent penalty, to the County Auditor. The notice shall be served upon the abutting owners or their representatives in the manner prescribed by State law.

(c) If, upon the expiration of fifteen days from the time of serving notice, as provided by subsection (b) hereof, the repairs required by the notice have not been made, the Director of Public Service shall proceed without delay to make such repairs. Immediately upon the completion thereof, the Director shall charge the expense separately against each abutting lot or land owner and shall enter the same in a book to be kept for that purpose which shall be open to public inspection. If, at the expiration of thirty days from the time of completing the repairs, any of the amount so charged remains unpaid to the Finance Director, the Director of Public Service shall cause such unpaid amounts, together with a five percent penalty, to be certified to the County Auditor for placement on the tax duplicate and collection in the same manner as other taxes are collected. Each abutting property owner shall be charged with the expense of repairing the part of the sidewalk upon which his or her land abuts. Such expense shall be a lien upon each lot or parcel of the abutting property as soon as repairs have been completed in front of such lot or parcel.
