(a) Any interested party may appear before the Director of Public Service and request a determination that the nuisance is abated or that the plan to ensure that the conduct, activities or conditions constituting the nuisance will not re-occur has been completed or initiated. The interested party shall request to make such an appearance on a form prescribed by the Director of Public Service.
(b) If the Director of Public Service determine the interested party has abated the nuisance or has completed or intitated the plan to ensure that the conduct, activities or conditions constituting the nuisance will not re-occur, the Director of Public Service shall advise the interested party and the Enforcement Official of that determination and the next, subsequent nuisance event or the failure of the compliance plan shall be referred to the Director of Public Service subject only to the notice requirements set forth in Section 686.05(a).
