634.21 LOADING AND UNLOADING OPERATIONS.
   (a)   Any owner or occupant of any establishment or institution at which litter is attendant to the packing and unpacking or to the loading and unloading of materials at an exterior location shall provide suitable containers at such place for the disposal and storage of such litter, and shall at all times maintain the dock area free of litter in such a manner that litter will be prevented from being carried or deposited by the elements upon any public place or private premises.

   (b)   Whoever violates this section is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred and fifty dollars ($250.00) or imprisoned not more than thirty days, or both, for the first offense, and shall be guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both, for each subsequent offense.
