626.01 CAUSING OR PERMITTING UNNECESSARY OR EXCESSIVE NOISE PROHIBITED.
   (a)   No person or organization shall cause or allow to be caused noise exceeding the following guidelines at the property line: During the hours of 8:00 a.m. through 9:00 p.m., an average of 55 dB is permitted; during the hours of 9:00 p.m. through 8:00 a.m. the following day, the average level is reduced to 45 dB. Noise measurements are in concordance with recommended EPA guidelines for community noises.
   (b)   No person or organization shall make, continue or cause to be made or continued any unnecessary, excessive or offensive noise which annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others within the City.
   (c)   No person, being the owner or the person in possession or control of the premises by reason of employment, agency or otherwise, whether such ownership, possession or control is exclusive or joint, shall permit a violation of this chapter.
   (d)   Subject to the provisions of Section 626.15, whoever violates this section is guilty of a minor misdemeanor and shall be subject to the penalty provided in Section 698.02.
