§ 154.007 APPROVAL OF SUBDIVISION AND RECORDING THEREOF REQUIRED BEFORE SUBDIVIDING, CONSTRUCTION, CONVEYANCE, AND THE LIKE; METES AND BOUNDS DESCRIPTION PRIMA FACIE EVIDENCE OF VIOLATION.
   (A)   No person shall subdivide land, nor shall city utilities be furnished to lots created in violation of the ordinance or chapter, nor shall construction of any kind commence on subdivided land, nor shall transfer of ownership be made of subdivided land prior to the approval of a subdivision of land by the City Commission pursuant to this chapter and prior to the recording of the subdivision in the office of the County Clerk and Recorder of the County.

   (B)   Until the City Commission has approved a subdivision, the owner (or his or her agent) of the land within the subdivision shall not transfer or sell, or agree to transfer or sell, or negotiate to transfer or sell the land, or any part of it, by reference to or the exhibition of, or any other use of a plat or subdivision of the land and, if that should be done, the owner, or his or her agent, shall be guilty of a misdemeanor and upon conviction shall be penalized in the manner prescribed by law.
   (C)   The description by metes and bounds in an instrument of transfer or other document used in the process of selling or transfer shall be prima facie evidence of an evasion of these regulations and that a misdemeanor has occurred.
