(A) Permitting premises to be used for gambling consists of either:
(1) Knowingly permitting any property owned or occupied by the person or under his or her control to be used as a gambling place; or
(2) Knowingly permitting a gambling device to be set up for use for the purpose of gambling in a place under his or her control.
(B) Whoever commits permitting premises to be used for gambling is guilty of violating this section.
