§ 130.060 CURFEW.
   (A)   For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
      PUBLIC PLACE. All public streets, alleys, and all places of public resort, including, but not limited to, the following: stores, shops, vehicle service stations, theaters, bowling alleys, pool halls, railway and bus terminals, dance halls, nightclubs, bars, and restaurants.
   (B)   Except as hereinafter provided, no person under the age of 18 years shall be in any public place between the hours of 10:00 p.m. and 5:00 a.m. of the following day, unless accompanied by a parent, guardian, or some other adult person acting in the place of a parent and exercising parental responsibility.
   (C)   On Friday and Saturday nights, and on any night which does not precede a day when school attendance is required in the public schools, the curfew provided for in division (B) above shall begin at 12:00 p.m. in the case of persons under the age of 18 years who have completed the ninth grade in school.
   (D)   Failure of parental responsibility consists of a parent or guardian knowingly permitting, aiding, or encouraging his or her child or ward to be in a public place in violation of this section.
   (E)   For good cause and upon request, the City Manager may extend the curfew hours contained herein.
   (F)   Whoever violates any provision of this section or commits failure of parental responsibility is guilty of violating this section.
   (G)   This section does not apply to a minor who is:
      (1)   Accompanied by the minor’s parent or guardian;
      (2)   On an errand at the direction of the minor’s parent or guardian, without any detour or stop;
      (3)   In a motor vehicle involved in interstate travel;
      (4)   Engaged in an employment activity, or going to or returning home from an employment activity, without any detour or stop;
      (5)   Involved in an emergency;
      (6)   On the sidewalk abutting the minor’s residence or abutting the residence of a next-door neighbor if the neighbor did not complain to police officers about the minor’s presence;
      (7)   Attending an official school, religious, or other recreational activity supervised by adults and sponsored by the city, a civic organization, or another similar entity that takes responsibility for the minor, or going to or returning home from, without any detour or stop, an official school, religious, or other recreational activity supervised by adults and sponsored by the city, a civic organization, or another similar entity that takes responsibility for the minor;
      (8)   Exercising First Amendment rights protected by the United States Constitution, such as the free exercise of religion, freedom of speech, and the right of assembly; or
      (9)   Married or had been married or had disabilities of minority removed in accordance with state law.
