§ 93.001 EXCAVATIONS IN OR ADJOINING STREETS, ALLEYS, AND THE LIKE TO BE FENCED; RED LIGHTS TO BE POSTED.
   Every person who shall cause to be made any excavation in or adjoining any public street, alley, highway, or public place shall cause the same to be fenced in with a substantial fence not less than 3 feet high and so placed as to prevent persons, animals, or vehicles from falling into the excavations. Every person making or causing to be made any excavation, and every person who shall occupy or cause to be occupied any portion of any public street, alley, highway, or public place with building materials or any obstruction, shall cause 1 red light to be securely and conspicuously posted in or near the excavation, building materials, or obstruction, if it does not extend more than 10 feet in length, and if over 10 feet and less than 50 feet, 2 red lights, 1 at each end, shall be so placed. In addition to the lights at each end, 1 additional light for each additional 50 feet or part thereof shall be placed along the excavation, building materials, or obstruction. The lights shall be kept burning during the entire night.
