(A) (1) Whenever in this chapter an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whenever in this chapter the doing of any act is required or the failure to do any act is declared to be unlawful, and no specific penalty is provided therefor, the violation of any provision or the failure to perform any act shall be punishable by a fine of not exceeding $500 or by imprisonment not to exceed 90 days, or by both the fine and imprisonment, in the discretion of the court.
(2) Each day any violation or failure to perform the act shall continue shall constitute a separate offense and a separate violation of an ordinance of this city, unless otherwise specifically provided.

(B) (1) Whoever violates § 70.06(A) shall be fined a sum of not more than $3.
(2) Whoever violates § 70.06(C) shall be fined a sum not to exceed $25.

(C) In addition to the penalty assessment established for each penalty assessment misdemeanor, there shall be assessed a penalty assessment fee as follows.
(1) Traffic safety fee.
(a) A traffic safety fee of $3 shall be assessed, which shall be credited to the Municipal Traffic Safety Education and Enforcement Fund.
(b) All money collected pursuant to division (C)(1)(a) above shall be deposited in the Municipal Traffic Safety Enforcement Fund in the municipal treasury and shall be used only by the Raton Police Department. The fund shall be used to institute and promote the program of traffic safety through education and enforcement to reduce serious and fatal traffic accidents and to provide for the purchase of equipment and support services as are necessary to establish and maintain the program. (2) Municipal court automation fee.
(a) A municipal court automation fee of $6 shall be assessed, to be credited to the Court Automation Fund. The fee shall be in effect and continue as long as authorized pursuant to NMSA §§ 66-8-116.3 and 66-8-119, as amended, or any other applicable statutes, and will continue in full force and effect unless and until otherwise terminated by action of the State of New Mexico, and will further either be decreased, increased, or subject to any other applicable provisions by the legislature regarding the sections, without further action by the governing body of the City of Raton.

(b) All money collected pursuant to division (C)(2)(a) above shall be deposited in the Municipal Court Automation Fund. The fund shall be used to provide for the purchase of equipment and support services as necessary to maintain the Municipal Court.
