First and second violations of this chapter shall be deemed infractions, with first violations being punishable by a penalty of one hundred dollars ($100.00) and second violations being punishable by a penalty of two hundred dollars ($200.00). Any person in violation of this chapter for a third or more times during a five (5) year period beginning on the date that judgment is entered for the first infraction shall be guilty of a misdemeanor punishable as provided in subsection 1-4-1A of this Code.
