4-1-4: DECLARATION OF NUISANCE:
   A.   No person in charge of or in control of premises, whether as owner, lessee, tenant, occupant or otherwise, shall allow any "nuisance" as defined in this chapter to remain on the premises unless such nuisance is maintained in an enclosed building or so located within a fenced or screened enclosure six feet (6') in height within the rear yard of the premises, such that the materials are not readily visible from any public place or from any surrounding property. This section shall not apply with regard to any vehicle, equipment or other personal property on the premises of a business enterprise operated in a lawful manner, when the keeping or maintenance of such vehicle, equipment or other damaged and abandoned personal property is necessary to the operation of such business and is not in violation of other provisions of the law.
   B.   For the purposes of this chapter, the term "nuisance" is defined to mean any condition or use of premises or of building exteriors which is detrimental to the property of others or which causes or tends to cause substantial diminution in the value of other property in the neighborhood in which such premises are located. This includes, but is not limited to, any of the following:
      1.   Litter, junk, debris, rubbish or trash covered areas, including exterior areas under any roof not enclosed by walls, including, but not limited to, areas that contain items such as cans, bottles, wood, metal, plastic, rags, boxes, paper, tires, auto parts; used, inoperable, worn out or discarded appliances or other household items; lumber, scrap iron, tin and other metal not neatly piled, or anything whatsoever that is or may become a hazard to public health and safety, or may harbor insect, rodent or vermin infestations. This subsection shall not be deemed to include items kept in covered bins or metal receptacles approved by the Panhandle Health District or the City of Rathdrum.
      2.   Exterior areas used or maintained as junkyards or dumping grounds.
      3.   The outside parking and storage on residentially zoned property of vehicles, materials, supplies or equipment not customarily used for residential purposes.
      4.   Placement or storage of pipe, lumber, steel, machinery, or similar materials, including all materials used in connection with a business, on residentially zoned property unless said materials are stored in a completely enclosed building.
      5.   All refuse of every nature, description or kind which has resulted from the construction of any structure and remains after the structure is completed, including all lumber scraps, shingles, plaster, brick, stone, concrete and other building material.
      6.   Inoperable or dismantled vehicles.
      7.   Display of vehicles with a sign advertising the vehicle for sale on residentially zoned property. This shall not apply to two (2) or fewer vehicles that belong to the property owner or are displayed on the property with the permission of the property owner and the vehicles are not being sold in connection with a vehicle sales business.
      8.   All offensive and noxious weeds or plants within the limits of the City.
      9.   Accumulations of weeds and grasses and other growths upon property within the City limits constitute a source of fire hazard and shall be removed, cut and destroyed by the owner or agent of the ground or premises on which the same is located. It shall be the duty of the owner, agent or person having charge of any property within the City limits where offensive or noxious weeds or plants are growing to remove, cut and/or destroy the same.
      10.   Any lumber, straw, hay, shavings, rubbish and refuse building materials or any combustible or inflammable substance or materials which may be ignited by fire, or through which fire may be communicated, placed within one hundred feet (100') of any building. Except that the City Council grant permits for a limited time specified in such permit and under such reasonable regulations and restrictions as may be imposed in the order granting such permit to any person to so store materials for building or other lawful purposes.
