4-1-3: DEFINITIONS:
For the purpose of this chapter, certain terms are herewith defined. When not inconsistent with content, words used in the present tense include the future; words in the singular number include the plural; words in the plural number include the singular; the word "persons" may be taken for persons, association, firm, copartnerships or corporation; the word "structure" includes building; the word "occupied" includes premises designed or intended to be occupied; the word "used" includes designed or intended to be "used"; the word "shall" is always mandatory and not merely directive; the word "may" is permissive; and the word "should" is a preferred requirement.
ABANDONED VEHICLE: Any vehicle, trailer, or semitrailer of a type subject to registration under state of Idaho statutes which has been left unattended in one location on public property, including any portion of a highway, street, alley or other right of way, or upon private property for a period of forty eight (48) hours without the consent of the owner or lessee of such property or his or her legally authorized agent.
ADMINISTRATOR: An official having knowledge in the principles and practices of zoning who is appointed to administer this chapter.
DEBRIS: The remains of something broken down or destroyed.
DISMANTLED: Any vehicle which has been materially altered by the removal of essential parts so as to render the vehicle inoperable.
DUMPING GROUND: Any area that is used for the storing, leaving or abandoning of refuse, garbage, waste, earth, rock or debris, including construction, agricultural, landscape, residential, commercial and industrial solid waste.
GARBAGE: Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.
INOPERABLE VEHICLE: A vehicle that is physically incapable of its intended operation or unable to be safely operated at that time, including, but not limited to, vehicles on blocks or similar devices, with a deflated tire or tires, or from which the engine, wheels or tires have been removed.
JUNK: Scrap metal of all types, batteries, tires, old appliances or parts thereof, parts of motor vehicles, glass, rags, cans, paper, rubber, debris, trash, cardboard, old wood or lumber, old furniture and mattresses, or dismantled, inoperable or unregistered vehicles.
JUNKYARD: A place used for the storage, keeping or abandonment of junk, stripped, substantially damaged, discarded or dismantled vehicles or machinery, or parts thereof, scrap metals, rags or other scrap materials, including places used for the wrecking, disassembling, repair or rebuilding of vehicles or machinery of any kind.
LITTER: Includes any rubbish, refuse, waste materials, weeds, paper, glass, cans, bottles, organic or inorganic trash, debris, dead animals, or any foreign substance of any kind or description, including junked or abandoned vehicles, regardless of their value.
PREMISES: Any piece of improved or unimproved real estate.
PUBLIC PLACE: Any and all dedicated streets, sidewalks, boulevards, alleys or other public ways, and any and all public parks, squares, spaces, grounds and buildings.
REFUSE: All putrescible and nonputrescible solid wastes (except body wastes), including garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles and solid market and industrial wastes.
RESPONSIBLE PARTY: An owner, lessee, cotenant or occupant of all real property including buildings, grounds, lots or premises, but shall not include any federal, state or local government or agency or political subdivision.
RUBBISH: Nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, leaves, wood, glass, bedding, crockery and similar materials.
TRASH: Something in a crumbled or broken condition or mass, including debris from pruning or processing plant material.
VEHICLE: A machine propelled by power other than human power designed to travel along the ground, water or air to transport persons, property or machinery and shall include, without limitation, automobile, truck, trailer, motorcycle, tractor, boat or aircraft. (Ord. 441, 1-11-2005)
