A. Amount Calculated: The amount of the impact fee shall be calculated using the methodology contained in the "report".
B. System Improvements: A development impact fee shall not exceed a proportionate share of the cost of system improvements determined in accordance with section 67-8207, Idaho Code. Development impact fees shall be based on actual system improvement costs or reasonable estimates of such costs.
C. Payment: A developer shall have the right to elect to pay a project's proportionate share of system improvement costs by payment of development impact fees according to the fee schedule as full and complete payment of the development project's proportionate share of system improvement costs, except as provided in section 67-8214(3), Idaho Code. The schedule of development impact fees for various land users per unit of development shall be as set forth in the "report".
D. Proportionate Share Determination: All development impact fees shall be based on a formula or method under which the development impact fee imposed complies with the requirements of chapter 82, title 67, Idaho Code. The methodology employed shall be explained in the "report" made applicable to impact fee determination. (Ord. 526, 11-15-2011)
