Any person who shall violate any of the provisions of the foregoing codes hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made pursuant to the foregoing codes, or who shall build in violation of any detailed statement of specifications or plans submitted and approved in accordance with the foregoing codes or any certificate or permit issued thereunder shall severally for each and every such violation and noncompliance respectively be guilty of an infraction, and upon conviction shall be fined not more than three hundred dollars ($300.00). Any person found to be in violation of this chapter three (3) or more times during a five (5) year period beginning on the date that judgment is entered for the first infraction shall be guilty of a misdemeanor, and be punishable under section 1-4-1 of this Code. The imposition of one penalty for any violation shall not excuse the violation nor permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time. A separate violation is deemed to have occurred with respect to each building or structure not in compliance with this chapter. Further, when not otherwise specified, each day that such violations are maintained or allowed to continue shall constitute a separate offense. (Ord. 576, 3-27-2019)
