ORDINANCE NO. 630

AN ORDINANCE OF THE CITY OF RATHDRUM, KOOTENAI COUNTY, A MUNICIPAL CORPORATION OF THE STATE OF IDAHO, AMENDING SECTIONS WITHIN TITLE 9, CHAPTER 2, OF THE RATHDRUM CITY CODE, KNOWN AS THE MECHANICAL CODE AND FUEL GAS INSTALLERS CODE, AS FOLLOWS.

AMENDING RATHDRUM CITY CODE SECTION 9-2-5 TO PROVIDE FOR AN UDPATE OF THE ADOPTED MECHANICAL CODE OF THE CITY OF RATHDRUM TO THE 2018 INTERNATIONAL MECHANICAL CODE AND AN UDPATE OF THE ADOPTED FUEL GAS CODE OF THE CITY OF RATHDRUM TO THE 2018 INTERNATIONAL FUEL GAS CODE IN ORDER TO REFLECT THE INTERNATIONAL MECHANICAL CODE AND INTERNATIONAL FUEL GAS CODE ADOPTED BY THE STATE OF IDAHO; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE.

IT IS ORDAINED by the Mayor and City Council of the City of Rathdrum, Kootenai County, Idaho, as follows:

Section 1. That Section 9-2-5 of the Rathdrum City Code shall be, and the same is amended as follows:

9-2-5: INTERNATIONAL MECHANICAL AND FUEL GAS CODES ADOPTED:

The international mechanical code, 20122018 edition, prepared by the International Code Council, Inc., except for sections 103.2 and 103.3, and the international fuel gas code, 20122018 edition, except for sections 103.2 and 103.3, are hereby adopted and shall be the mechanical code and fuel gas code of the municipality for regulating the erection, construction, enlargement, alteration, repair, removal, conversion, and replacement of heating, ventilation, air conditioning, cooking, refrigeration, incinerators, gas piping, and other heat producing appliances within the municipality. Provisions for the issuance of permits and collection of fees, and all regulations, conditions, provisions and terms of such codes, are hereby adopted and made a part hereof as if fully set forth in this chapter. Section 2. Severability.

The ordinance is hereby declared to be severable. Should any portion of this ordinance be declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purpose(s) of the ordinance before the declaration of partial invalidity.

Section 3. Repealing of Conflicting Provisions.

All provisions of the current Rathdrum municipal Code or ordinances of the City of Rathdrum which conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict.

Section 4. Effective Date.

This ordinance shall be effective upon passage and publication as provided by law.
