7-7-7: UTILITY COMPANIES:
   A.   Plan Submission:
      1.   Unless otherwise exempted from the provisions of this section due to a franchise agreement between the city and a utility company, the owner of the utility company responsible for installing and/or constructing any aboveground or buried system of cables, conduits, pipes, ducts, tunnels or any appurtenances within the public right of way or other public place for the purpose of supplying or conveying oil, gas, electricity, communications in, to or from the city, or to or from any parcel of land within the city shall be responsible for obtaining the required right-of-way permits for any right-of-way work to be completed by the utility company or a sub-contractor.
      2.   Utility companies shall submit to the public works department, on behalf of themselves and/or any subcontractors, the permit application and all required additional documentation, including detailed plans and specifications, certificate of insurance completed in accordance with this chapter, a public works license, if applicable, at least five (5) business days before commencing work. Plans shall clearly illustrate by coordinates, distances and bearings, the exact location, size, descriptions and elevations of all pipes, conduits, ducts, cables, tunnels or appurtenances to be installed or constructed within the public right of way or other public places. Plans shall be accurately reproduced to a standard scale. If using sub-contractor(s) to complete the work covered by a permit, the utility company shall also submit for each sub-contractor, a certificate of insurance that is completed in accordance with this chapter and a public works license, if applicable.
      3.   The owner of the utility company shall, within ten (10) business days following the completion of work, submit an as constructed plan or set of plans showing all corrections and changes marked clearly in red and shall indicate the date of installation, including the date of service connections.
      4.   The owner of the utility company which is responsible for any existing aboveground and/or buried systems of cables, conduits, pipes, ducts, tunnels or any appurtenances shall submit a plan or set of plans showing the location and description of the system components within thirty (30) days following notice by the public works director or the director's designee.
      5.   The city may require that a utility company provide a performance bond to the city for either a specific permit or to cover all work that a utility company completes in the city.
   B.   Protection Of Utilities: The owner of any utilities within the public right of way or other public place shall bear all costs of relocating, removing, shoring, supporting or protecting the utility in the event it becomes necessary for the city or any authorized contractors to perform work under, above, across or adjacent to the utility within the public right of way or other public place.
