7-7-2: PERMIT REQUIRED:
It is unlawful for any person, unless specifically exempted by this chapter, to injure or damage any features, place any materials or improvements, or interfere with the design or function of improvements placed, or perform work within the public right of way or other public place without first obtaining either a major or minor right of way encroachment permit from the public works director, city engineer, or the director's designee. Activities requiring permits include, but are not limited to, grading and drainage required for approaches, trenching and backfilling required for buried utilities, modifications, repairs and maintenance of existing facilities, alterations of roadside drainage swales, landscaping, including the removal and/or trimming of trees, temporarily closing or obstructing rights-of-way, erecting fences in, alongside, or from the public right of way, signs or other fixed objects, constructing curbs, sidewalks, drives and drainage structures, parking in or on the right of way with equipment or in non-parking areas, constructing detours and/or closing streets.
   A.   Temporary road closures shall include any type of work, actions, and/or use of equipment and/or materials in or on any portion of the right-of-way, including the street, alley, or sidewalk, that presents a danger or potential hazard to the traveling public, both vehicular and pedestrian. This shall include, but not be limited to, any work requiring or needing traffic control, cones, or road signs, any work in which equipment and/or materials remain in any portion of the right-of-way after dark, and potentially hazardous obstructions in or on rights-of-way that receive significant traffic. Temporary road closures will require a major ROW permit as described within this chapter.
   B.   Obstructions shall include any type of work in which materials and/or equipment are put in or on any portion of the right-of-way in which said materials and/or equipment merely obstruct a portion of the right-of-way with both pedestrian and vehicular traffic still having the ability to travel by without risk of danger or hazard, said materials and/or equipment are only in the rights-of-way for a short temporary period of time and not after dark, and said right-of-way that is being obstructed by the materials and/or equipment is a typical residential right-of-way with minimal traffic. Obstructions will require a minor ROW permit as described within this chapter.
   C.   Erecting signs shall not require a permit pursuant to this chapter, but shall require a sign permit pursuant to the Zoning Title. (Ord. 556, 5-10-2017; amd. Ord. 622, 6-14-2023)
