6-1-1: SPEED LIMITS:
   A.   Established: Unless posted signage indicates to the contrary, all streets within the city limits of Rathdrum and under the jurisdiction of the city of Rathdrum, shall bear a maximum speed limit for vehicles of twenty five (25) miles per hour, with the following exceptions:
      1.   The speed limit in areas designated as school zones shall be fifteen (15) miles per hour when children are present. For the purpose of this section, the term "when children are present" shall have the meaning set out in Idaho Code section 49-658 and any subsequent amendments thereto.
      2.   The city engineer, with the approval of the mayor, may adopt a temporary speed limit lower than the customary speed limit in a given area when such speed limit is deemed necessary to cover special conditions arising from construction zones or other traffic hazards. The temporary speed limit shall be posted in conformance with Idaho Code section 49-209.
   B.   Violations: Any vehicle in excess of the speed limits established by this section or by signage posted by the city pursuant to determination of the city engineer or city council is deemed not reasonable and prudent, and the same is unlawful. Violation of this section shall be subject to punishment as an infraction. The penalty for an infraction violation shall be as determined by order of the Idaho supreme court, as such is adopted from time to time. (Ord. 495, 11-12-2008)
