5-4-2: CURFEW:
   A.   It is unlawful for any minor to be upon any public place or private property open to the public between the hours of twelve o'clock (12:00) midnight and five o'clock (5:00) A.M. unless the person is accompanied by a parent, legal guardian or any other adult person lawfully and properly accompanying the minor person, or unless provided for herein.
   B.   It is unlawful for any parent or legal guardian to knowingly permit or allow the minor to be present, without a specific purpose and without a parent or guardian, in any public place or private property open to the public within the city during curfew hours.
   C.   It is unlawful for an owner, operator, or any employee of an establishment to knowingly allow a minor, without permission of a parent or guardian, to be present upon the premises of the establishment during curfew hours, unless the establishment is involved in rendering services for an emergency or is a designated "safe place" and the minor is seeking emergency help, shelter, or care. It is a defense to prosecution under this section that the owner, operator, or employee of an establishment asked the minor to leave the premises and promptly notified the Law Enforcement Department for the City that a minor is present on the premises of the establishment during curfew hours and refuses to leave.
