5-2-2: DEFINITIONS:
Unless the context otherwise indicates, the following definitions shall apply:
 
ANIMAL:
Any domestic vertebrate creature, including a dog, cat, horse, cow, bird, reptile, fish or other domesticated animal.
ANIMAL HOSPITAL:
Any establishment maintained and operated by a licensed veterinarian for surgery, diagnosis and treatment of animal diseases and injuries.
ANIMAL CONTROL OFFICER:
The deputized officer of the Rathdrum police department charged with the enforcement of this chapter; in the absence or unavailability of the animal control officer, any city police officer shall have the same authority and duties herein prescribed.
ANIMAL SHELTER:
Any facility operated for the temporary care, confinement and detention of animals and for the humane euthanizing and other disposition of animals or any facility authorized by the chief of police or his designee to impound, confine, detain, care for or destroy any animal.
AT LARGE:
Off the premises of the owner and not under the control of the owner, a member of the owner's immediate family or the owner's agent either by leash, cord or chain strong enough to restrain the animal. This definition shall include the phrase "running at large".
BITE:
The breaking of the skin by the teeth of an animal, such as a dog.
CLERK:
The Rathdrum, Idaho, city clerk or designated appointee of the city clerk.
DOG:
Any domesticated Canis familiaris (herein "canine"), or hybrid thereof, of any age and any gender unless otherwise indicated.
DOMESTIC ANIMAL:
Includes dogs, cats, domesticated sheep, horses, pigs (excluding potbellied pig), cattle, goats, sheep, nonpoisonous snakes less than three feet (3') in length, pigeons, ducks, geese, turkeys, chickens, confined domestic hares and rabbits, pheasants, guinea pig, hamster, gerbil, frog, ferret, mouse, rat, and other birds and animals raised and/or maintained in confinement.
EXOTIC ANIMAL:
Any live monkey, alligator, crocodile, cayman, raccoon, skunk, fox, bear, sea mammal, poisonous snake, nonpoisonous snakes more than three feet (3') in length, members of the feline species other than domestic cat (Felis domesticus), members of the canine species other than domestic dog (Canis familiaris) or any other animal that by virtue of strength or inherent temperament or disposition would require a standard of care and control greater than that required for customary household pets sold by commercial pet shops or domestic farm animals.
 
GUIDE DOG:
A dog that has been properly identified as being from a recognized school for seeing eye, hearing ear, or guide dogs, and the dog is properly harnessed or leashed so that the blind, physically disabled or hearing impaired person may maintain control of the dog, and the dog has attached to its harness or collar a special and brightly colored fluorescent tag issued by the commission for the blind and visually impaired under the provisions of 67-5407, Idaho Code. A "guide dog for the physically disabled" means any dog individually trained to the physically disabled participant's requirements including, but not limited to, minimal protection work, rescue work, pulling a wheelchair or fetching dropped items.
GUARD OR ATTACK DOG:
A dog trained to attack on command or to protect persons or property.
HOUSEHOLD:
Living quarters, including the appurtenant yard and premises occupied by one or more persons as a living abode.
IMPOUNDMENT:
The taking into custody of an animal by any police officer, animal safety officer, or any authorized representative thereof.
KEEP:
Shall be interchangeable with harbor and means possessing, controlling, exercising, maintaining or allowing to run at large.
KENNEL:
Any premises wherein any person engages in the business of boarding, breeding, buying, letting for hire, training for a fee or as such term might otherwise be defined by the zoning ordinance of the city.
MUZZLE:
A device constructed of strong material designed to fasten over the mouth of an animal to prevent the animal from barking or biting.
 
 
OWNER:
Any person having temporary or permanent custody of, sheltering or having charge of, harboring, exercising control over, or having property rights to, any animal covered by this title. An animal shall be deemed to be harbored if it is fed or sheltered by any person or if the person purported to be harboring claims to have custody or responsibility for the care of any animal.
PERSONS:
Any person, persons, firm, association or corporation owning, keeping or harboring an animal.
POTBELLIED PIG:
A Vietnamese or Chinese potbellied pig kept for the sole purpose of providing human companionship.
PREMISES:
Other than household premises, means that property belonging to the owner, a member of the owner's immediate family or the owner's agent. For purposes hereof, "premises" shall also be intended to mean the inside of a closed motor vehicle.
VICIOUS OR DANGEROUS ANIMAL:
Any animal that attacks, bites, or physically injures human beings, domestic animals, or livestock without adequate provocation, or which, because of temperament or training, has a known propensity to attack, bite, or physically injure human beings, domestic animals, or livestock. Any wild animal or any animal that without adequate provocation has bitten or attacked a human being or other animal shall be prima facie presumed vicious or dangerous.
WILD ANIMAL:
Any live, nonhuman primate, leopard, panther, tiger, lion, lynx or any other warm blooded animal that can normally be found in the wild state. The term "wild animal" does not include: domestic dogs (excluding hybrids with wolves, coyotes or jackals), domestic cats (excluding hybrids with ocelots or margays), farm animals, rodents, any hybrid animal that is part wild, and captive bred species of common cage birds.
