§ 155.15 TOWN PROTOCOL FOR ENTERING ONTO TOWER PROPERTIES.
   (A)   Generally. The town adopts the following rules and regulations for the entry onto the town’s tower properties. These rules and regulations are intended to promote safety and protect the town’s properties from unauthorized access. They are intended to apply not only to the real estate on which the town’s towers are located, but also the towers and any attachment, fixture or structure related to the towers (all of which are hereafter referred to as “the towers” or similar designations).
   (B) Rules and regulations.
      (1)   The town’s Public Works Department (or its successors) shall govern its employees’ entry and movement about the town’s towers.
      (2)   Except for the Town Manager, the town’s law enforcement employees, Fire Chief or his or her designee, or Public Works Department employees acting in the course and scope of their employment, no person shall enter onto tower properties except:
            (a)   During regular business hours;
            (b)   Upon first obtaining the express permission of the Town Manager or his or her designee;
            (c)   Upon first providing to the Town Manager or his or her designee sufficient proof (acceptable to the Town Manager, or his or her designee, in his or her sole discretion) of adequate insurance coverage of $1,000,000 general liability coverage; and
            (d)   Upon providing to the Town Manager or his or her designee written agreement to indemnify and hold harmless the town, its employees, Board of Commissioners members and officers for any loss, damage, injury, compensation or loss relating to the town’s tower properties.
      (3)   No person shall install or locate (or collocate) on the towers any camera, radios or other equipment of any kind without the express, written agreement of the town, approved by the Board of Commissioners in open session. If any equipment is found on the town’s tower properties for which there is no agreement, the town shall remove and dispose of the equipment in whatever ways the town in its sole discretion deems appropriate.
      (4)   Failure to comply with these rules and regulations will result in immediate removal of any equipment from the town-owned tower.
   (C)   Protocol for entering onto tower properties.
