For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires otherwise.
ANTENNA. A conductor by which electromagnetic waves (telephonic, radio, television, microwave or otherwise) are transmitted or received.
BOARD OF ADJUSTMENT AND PLANNING BOARD. The Board of Adjustment and Planning Board of the Town of Ranlo.
BOARD OF COMMISSIONERS. The Board of Commissioners of the Town of Ranlo.
CONSTRUCTION. Any new construction, reconstruction, alteration or expansion of a new or existing tower.
ENFORCEMENT OFFICER. The person, officer or official and his or her authorized representative, whom the Town Manager has designated as the agent for the administration and enforcement of this chapter.
FALL AREA. A circle whose center is the base of a telecommunications tower and whose radius is equal to one and one-half the tower’s height. A FALL AREA of one-half to one will be acceptable with a signed and sealed statement by a registered professional engineer licensed by the state indicating such FALL AREA would prevent the tower’s fall from encroaching onto adjoining property.
PERSON. Any individual, partnership, firm, association, joint venture, public or private institution, utility, cooperative, interstate body, the state and its agencies and political subdivision, or other legal entity.
RESIDENT. Any person residing, doing business or maintaining an office within the town or its extraterritorial jurisdiction.
STRUCTURE. Anything constructed or erected, including, but not limited to, buildings, that requires location on the land or attachment to something having permanent location on the land.
TELECOMMUNICATIONS TOWER. Any tower or structure erected for the purpose of supporting one or more antennas designed to transmit or receive signals (for example, telephonic, radio, television or microwave).
TOWER HEIGHT. The vertical distance measured from ground to the uppermost point of the tower and any antenna, structure or appendage fixed thereto.
TOWN MANAGER. The Town Manager of the Town of Ranlo.
VARIANCE. Official permission from the Board of Adjustment to depart from the requirement of this chapter.
