§ 53.02 DEFINITIONS.
   For the purposes of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ASSESSMENT FEE. An established fee for extensions of water distribution or sewer collection systems, determined in the same manner as the availability fee above. Such FEE is to be adjusted annually on July 1 to maintain a reasonable relationship between the FEE and actual cost, based on cost estimates prepared by the Town Engineer, audited by the Finance Director, and approved by the Town Coordinator.
   AVAILABILITY FEE. An established fee for connection to an existing water distribution or sewer collection system of the town. The method for determining this FEE shall be as set forth in the town’s “Policy for Extending Water and Sewer Facilities by Assessment and for Providing Water and Sewer Service from Existing Facilities”. This FEE is to be adjusted annually on July 1 to maintain a reasonable relationship between the fee and actual cost, based on cost estimates prepared by the Town Engineer, audited by the Finance Director, and approved by the Town Coordinator.
   ELIGIBLE REFUND. The portion of the project cost qualified for reimbursements to the applicant according to the stipulations in this chapter.
   EXTENSION. Any water main or sewer line lengthening required to connect a water service to a large water main or sewer lateral to an outfall sewer.
   FEASIBLE PROJECT. A project within the corporate limit of the city in which a majority of the property owners and a majority of all the lineal feet of frontage of the lands abutting upon the street proposed for improvements have signed a valid and sufficient petition requesting the described public improvement for projects inside the city limits.
   LARGE MAIN. Any water main larger than eight inches in diameter, serving an area, sized and located so that additional services connections beyond the limits of any associated development can be made without lowering the level of service.
   OUTFALL. Any sewer line serving a drainage area, located and sized so that additional lateral connections beyond the limits of any associated development can be made without lowering the level of service.
   TOWN’S SERVICE AREA. All areas inside and outside the corporate limits of the town serviced by the town’s water or sewer system and any future extensions thereof, except areas serviced by water mains or sewer lines of other municipalities.
