§ 150.40 CODE FOR SAFETY TO LIFE FROM FIRE IN BUILDINGS AND STRUCTURES.
   (A)   To achieve the objectives, the Life Safety Code, 1994 Edition, published by the National Fire Protection Association, Inc., Quincy, Massachusetts, and printed in book or pamphlet form, is hereby incorporated in this section by reference, in addition to all amended editions as though printed in full herein in so far as said Code does not conflict with the state statutes, and its provisions shall apply to and govern the use of all buildings in the city. One copy of the Life Safety Code handbook is on file at the office of the City Clerk and is available for public inspection at any reasonable time. Provisions of the Life Safety Code shall be controlling throughout the city and compliance with its provisions shall be mandatory within the boundaries of the city.
   (B)   It shall be unlawful for any person to violate this section by failing to comply with the provisions of the Life Safety Code or to permit or maintain such violation, to refuse to obey any provisions thereof, or to fail or refuse to comply with any such provisions or regulations, except as variation may be allowed by action of the Mayor and City Council in writing.
   (C)   The Mayor and the City Council shall have the power to grant exemption of application from specific requirements of regulations promulgated pursuant to this section upon request in writing when such request shows that the enforcement of the specific requirements will cause unnecessary hardship to the petitioner or in order to take advantage of new methods or equipment of recognized adequacy, provided that such request shall not be granted unless the requested equipment or use will, in the opinion of the Mayor and City Council, conform with all of the fundamental requirements of safety. The particulars of such exemptions, when granted, shall be entered upon the approval granted.
